Types of Criminal Offences
The Canadian Criminal Code identifies three broad categories of offences, including:
- Summary offence
- Indictable offence
- Hybrid offence
Summary offences are low-level offences such as minor assaults or offensive behaviour. They are usually heard in Magistrate courts and carry lower penalties.
Indictable offences are more serious offences tried by a judge or jury. They carry harsher penalties, including life imprisonment. Some examples of indictable offences include murder, treason, and drug trafficking.
Hybrid offences give the prosecution a choice to proceed by indictment or summarily. Domestic assault is an example of a hybrid offence.
Summary offences have a one-year limitation period for bringing claims against the accused. However, individuals can be charged with an indictable offence at any time.
What Is the Criminal Charge Process?
If you are charged with committing a crime, you will be arrested and placed in police custody. The officer will release you within 24 hours unless they reasonably believe:
- That you will fail to attend court
- That your release is against public interest
- That they will fail to follow the conditions of their bail
If you are not released, you may request a bail hearing. At the hearing, a judge will decide to grant you bail or keep you in jail.
Individuals who refuse bail will remain in custody until their trial. After appearing in court, officers will present you with information about your case.
It is presumed that you are innocent until proven guilty by the prosecution, but you will be given the chance to either plead guilty or not guilty to the charges brought against you. Trial will take place if you plead not guilty. When you enter a guilty plea, you admit to committing the crime, and the trial will be skipped.
During your trial, the prosecution and defense will present evidence to prove your guilt or innocence. If the jury or judge finds you guilty, you will be sentenced. If they do not, you will be acquitted.
