Prohibited Substances

Controlled substances in Canada are classified into schedules. The classification is done according to their chemical properties and effects. Some common substances related to drug offences in Canada fall under the following:

  • Schedule I drugs – such as cocaine, opium, codeine, methamphetamine, amphetamine and morphine

  • Schedule II drugs – such as synthetic cannabinoid receptors, their salts, and derivatives

  • Schedule III drugs – such as lysergic Acid Diethylamide (LSD), methylphenidate and mescaline

  • Schedule IV drugs – such as barbiturates, benzodiazepines and anabolic steroids

  • Schedule V drugs – such as N-Phenyl-4-piperidinamine analogues, derivatives, and salts

Schedule I and II substances carry the harshest penalties. Although cannabis is legal in Canada, there are certain restrictions on its possession. Possessing more than 3kg of cannabis in public is a criminal offence.

If a CBSA officer suspects that you are carrying prohibited substances or medication, they may detain you and enforce their powers under Section 101 of the Customs Act.

Legal Consequences of Illegal Drug Importation

Travelling with a prescription drug or medication containing a narcotic, controlled drug, or targeted substance is an offence. Canadian law requires that you meet certain conditions under Section 56 of the CDSA before you can legally import drugs. If you are caught importing drugs outside this exemption, you may face criminal charges for illegal drug importation.

The penalties for drug offences are serious. They may vary depending on the type of drugs imported, the amount, and the presence of any aggravating factors, such as importing drugs for the benefit of a criminal organization. The mandatory minimum jail term for importing Schedule I and II drugs is one year. If the Schedule I drug is above one kilogram, the term is two years.

According to Section 6(3) of the CDSA, importing drugs included under Schedule I and II is an indictable offence with a maximum punishment of life in federal prison. The punishment ranges between eighteen months and ten years for substances included in III, IV, or V.
